INDIANA ATTORNEY GENERAL MOTIONED TO WITHDRAW
FROM REPRESENTING JUDGE DAVID KIELY & INDICT HIM

Jesha Miller has motioned for Attorney Betsy M. Isenberg, representing
the Indiana Attorney Generals Office to withdraw from representing Judge
David Kiely & indict & arrest him pursuant to Title 18, sec. 243 which is the
exclusion of jurors on account of race. There is evidence in the trial transcripts that Judge Kiely committed the crime made to deter officials from excluding jurors on account of race. Aslo in this motion Judge Sarah Evans Barker, President of the Federal Judges Association is given until
June 30, 2010 to withdraw from violating Jesha Miller's rights under color of law as she dismissed the Complaint when he demanded a trial by jury which is a Constitutional Right & petitioned for her to enforce the Rule of Law by arresting Defendants in the case such as Congressman Brad Ellsworth, Robert Iger, & Katie Couric for concealment of the crime &
the Constitutions checks & balances so that officials are not held accountable.

Petitioner Moves For Betsy M. Isenberg to indict & arrest
Judge David Kiley pursuant to Title 18, sec. 243.
II.
Judge Sarah Evans Barker is given until June 30, 2010 to
withdraw from violating my rights under color of law or be
charged for violating Title 18, 242.

Comes now, Jesha Miller, who respectfully moves for the Indiana Attorney Generals Office, represented by Betsy M. Isenberg to withdraw Representing Judge David Kiley & indict & arrest Judge David Kiley for violating Title 18 sec. 243.

1. The Office of the Indiana Attorney General helps protect the rights, freedoms and safety you enjoy as a citizen of the Hoosier state. Attorney General Greg Zoeller and his staff are dedicated to meeting the state's legal needs, as well as the needs and interests of its citizens. { Not defend
criminal acts against the peace & dignity of the U.S. }
In the interest of freedom, justice, equality & the Constitution of the U.S. you have a duty to protect my rights which were violated by Judge David Kiely pursuant to Title 18 sec. 243 which is affirmed to be factual evidence from the trial transcripts.






Hill v. Texas 316 U.S. 400 316 U.S. 404 (1942) Thus, "no State is at liberty to impose upon one charged with crime a discrimination in its trial procedure which the Constitution, and an Act of Congress passed pursuant to the Constitution, alike forbid...It is our DUTY, as well as the State's, to see that, throughout the procedure for bringing him to justice, he shall enjoy the protection that the Constitution guarantees.
As the Plaintiff's allegations are true, then the officials responsible for the jury selection acted in violation of the Constitution, denying potential Black jurors the opportunity to participate in the administration of justice.
Strauder v. West Virginia Moreover, if petitioner's allegations are true, the responsible officials are subject to criminal penalties. 18 U.S.C. sec. 243.

1. (b) The Indiana Attorney Generals Office signed a waiver before the U.S. Supreme Court giving away all rights until called upon by the U.S.
Supreme Court because they could not justify the illegal restraint which
violated the unalienable right "all men are created equal which is protected by the 6th Amendments right to a speedy and public trial by an impartial jury
and to have the assistance of counsel for his defense. This also violates the
13th & 14th Amendments so that I specifically was held in violation of
Constitutional Law # 250.2 (4) which provides: Every Black Man has a right under the 14th Amendment to the Constitution U.S.C.A., that in the selection of jurors to pass on his life, liberty, or property, there shall be no exclusion of his race & no discrimination against them because of their color. Virginia v. Rives 100 U.S. 313

1. (c) Justification to act immediately & informing the media of your withdrawal & indictment of Judge David Kiely are the transcripts showing he
willfully denied the unalienable right to a fair trial by the exclusion of my own race & did not have a cross section of the community as required by Federal Law. Here he fails to perform his Constitutional DUTY-- recognized by sec. 4
of the Civil Rights Act of March 1, 1875. Also included is a copy of the
Indiana Attorney Generals office signature on that WAIVER.






II.
Judge Sarah Evans Barker is given until June 30, 2010 as to whether she will withdraw from violating my rights under color of law which is seven
(7) days or be charged under Title 18, sec. 242. To withdraw you must reinstate the complaint & indict & arrest the defendants already given Legal Notice & warning sent by me as part of the evidence submitted. The petition using the Constitutions Checks & Balances questions the integrity of the entire Judicial Branch of government who must be checked as required by
the Constitution to prevent abuse of power & protect the natural rights of the people to freedom, justice, equality, & the pursuit of happiness. I have the right to a trial by jury as originally demanded & you must enforce the Rule of Law by indicting those involved in concealing the checks & balances so that officials are not held accountable for breaking the LAW. This is the racism demonstrated by White Supremacy where they are not held accountable for violating the rights of Blacks which is hidden by the media. You as the President of the Federal Judges Association have refused to enforce the rule of law when your own colleagues are involved in breaking the law.
